Trans Inclusion in the Migration Sector: Resources and Reflections

In response to the recent Supreme Court ruling, we’ve worked with Rainbow Migration to publish a practical resource list. We hope these resources and guidance will help your organisation strengthen support for trans people—especially those most at risk—in the asylum and migration system.

Trans Inclusion in the Migration Sector: Resources and Reflections

Following the recent Supreme Court ruling on the definition of ‘sex’ under the Equality Act 2010, we partnered with Rainbow Migration to explore the implications of this decision for trans people—particularly trans women and trans people of colour—within the asylum and migration system.

As part of this collaboration, we invited Rainbow Migration to speak at a recent Insight Hub call, where they shared their legal and practical insights on the ruling. In response, Rainbow Migration developed a resource list and Refugee Action supported the publication of blog posts and the resource list, using our national platform to reach across the migration sector. 

About the Resources

The Trans Inclusion Resource List is a living document created to support organisations working with people seeking asylum and migrants. It includes:

  • Practical guidance on making services safer and more accessible for trans people

  • Legal context and analysis of the Equality Act 2010 and the recent Supreme Court ruling

  • Best practices for inclusive triaging, safeguarding, and signposting

  • Training opportunities, toolkits, and policy resources tailored for frontline services

  • Voices from the community, highlighting the lived experiences of trans people navigating the asylum system

Why this work was needed

The Supreme Court’s ruling has significant implications. By narrowing the legal definition of ‘sex’, it increases the risk of exclusion and harm for trans people navigating the UK’s asylum and immigration systems. These systems are already shaped by colonial and patriarchal structures, and this decision reinforces barriers to safety, dignity, and justice for trans individuals.
